Acceptance of these Terms
These Terms and Conditions (Terms) are a legally binding agreement between you and Square Digital Inc and Digiform Solutions LLC (doing business as "Swipe Flow Social," "Swipe Flow," "we," "us," or "our"). These Terms govern your access to and use of our websites, apps, and related services, including your Swipe Flow Social profile pages and any features we make available (collectively, the "Service"). By clicking "I Agree," creating an account, or accessing or using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use the Service. If you are under the age of 18, you may only use the Service with permission from a parent or legal guardian, and they are responsible for your use. You represent that your use of the Service is not prohibited by applicable law.
Beta Program Terms
The Service is currently offered as a limited beta release (the "Beta"), which may include an MVP feature set and usage limits. You acknowledge and agree that:
- The Beta is pre-release and may contain bugs, errors, and interruptions.
- Features may be added, removed, changed, or discontinued at any time.
- We may impose or change limits, including limits on the number of channels, links, posts, embeds, clicks, storage, or other usage-based features.
- We may suspend, disable, or end the Beta at any time, and we may not provide the Beta or any future version of the Service to you.
You understand that we are not obligated to maintain backward compatibility, maintain any particular feature, or continue offering any feature during or after the Beta.
Account Registration and Security
You are responsible for all activity under your account. You agree to provide accurate information and keep it current. You must keep your login credentials confidential and notify us immediately if you suspect unauthorized access. We may refuse, reclaim, or require changes to usernames or profile URLs that infringe rights, impersonate others, are misleading, or are otherwise inappropriate.
Your Profile is Public
The Service is designed for public profiles. Private profiles are not currently available. You acknowledge that:
- Your profile page and content you post in it may be publicly accessible.
- Your content may be shared by others and may appear on third-party platforms.
- Search engines may index your profile.
- You should not post sensitive personal information you do not want publicly visible.
- You are responsible for what you choose to publish.
Your Content and Your Responsibilities
"User Content" means anything you submit, upload, embed, publish, transmit, or otherwise make available through the Service, including text, images, video, graphics, links, product information, and any other materials. You are solely responsible for your User Content and the destinations you link to. You represent and warrant that:
- You own your User Content or have all rights necessary to post it and to grant us the licenses in these Terms.
- Your User Content and links do not infringe any intellectual property, privacy, publicity, or other rights.
- Your User Content is not deceptive, misleading, fraudulent, or unlawful.
- Your User Content does not contain malware, spyware, or harmful code.
Acceptable Use
You agree not to use the Service to:
- Break any law or regulation
- Promote fraud, scams, phishing, or deceptive offers
- Distribute malware or attempt to compromise systems or accounts
- Infringe intellectual property rights
- Harass, threaten, or encourage violence against others
- Promote hate or discrimination
- Post pornographic content involving minors, or exploit or endanger minors in any way
- Post oversexualized content or pornography
- Send spam or facilitate unsolicited messages
- Impersonate any person or entity, or falsely imply affiliation or endorsement
- Interfere with or disrupt the Service, including probing, scanning, or testing vulnerabilities
- Use automated scripts to create accounts, scrape content, or overload the Service without our written permission
We may investigate and take any action we deem appropriate, including removing content, limiting visibility, suspending accounts, or reporting to law enforcement.
License You Grant to Swipe Flow Social
You retain ownership of your User Content as between you and us. To operate and improve the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, display, perform, distribute, modify, adapt, and create derivative works of your User Content, solely as necessary to provide, maintain, market, and improve the Service.
Marketing Use of Your Content
By posting User Content on the Service, you also grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, distribute, modify, adapt, and create derivative works of your User Content in our marketing, advertising, and promotional materials, in any media now known or later developed. This marketing license includes the right to use your username, profile name, profile image, and any name, likeness, voice, photograph, and other personal attributes that appear in your User Content, solely in connection with featuring your User Content or your Swipe Flow Social profile. You acknowledge that we may continue using marketing materials that include your User Content even if you later delete that User Content from the Service.
Feedback
If you submit feedback, ideas, suggestions, or improvements about the Service, you grant us an unrestricted, worldwide, royalty-free, perpetual license to use and exploit that feedback for any purpose, with no obligation to you.
Third-Party Services and Links
The Service may allow you to link to third-party websites, products, and services, and may allow embedding or displaying content from third-party platforms. Third-party services are not under our control. We do not endorse and are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies. You are responsible for complying with those terms.
Plans, Limits, and Pricing Changes
We may offer free and paid plans and may change what is included in any plan, including usage limits, features, and availability. We reserve the right to change prices, introduce new fees, or modify plan structures. If you are on a paid plan, we will provide notice of price changes or material plan changes through the Service, by email, or by other reasonable means. Changes will take effect on the date stated in the notice, and where required by law, they will apply at renewal or after any required notice period.
Taxes, Refunds, and Payment Processing
If you purchase a paid plan, you agree to pay all applicable fees and taxes. Fees are generally non-refundable unless required by law or unless we state otherwise in writing. If payments are processed by a third-party processor, you agree to that processor's terms, and you authorize recurring charges where applicable.
Suspension and Termination
We may suspend or terminate your access to the Service at any time if:
- You violate these Terms
- Your User Content creates risk or potential legal exposure
- Your use harms the Service, other users, or third parties
- We are required to do so to comply with law or a legal request
- We decide to modify or discontinue the Service or the Beta
You may stop using the Service at any time. If account deletion is available, you may request deletion through the Service or by contacting us. Some information may be retained as required by law or for legitimate business purposes such as security, dispute resolution, and enforcing these Terms.
Intellectual Property
The Service, including its software, design, trademarks, logos, and all related intellectual property, is owned by Swipe Flow Social or its licensors. You receive only a limited, revocable, non-transferable right to use the Service in accordance with these Terms.
Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.
Limitation of Liability
To the maximum extent permitted by law: Swipe Flow Social will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) $100 USD. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Swipe Flow Social and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your User Content or your links
- Your use of the Service
- Your violation of these Terms
- Your violation of any law or third-party rights
Governing Law and Venue
These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of laws rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the courts located in Vancouver, British Columbia, unless applicable law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. If we make changes, we will update the "Last Updated" date. If changes are material, we will provide notice through the Service, by email, or by other reasonable means. By continuing to use the Service after the changes take effect, you agree to the updated Terms. If you do not agree, you must stop using the Service.

Using Swipe Flow
We use your information to create your account, personalize content, and improve Swipe Flow Social. You may choose to provide additional information that could have special protections under privacy laws in your region. You can access, update, or delete your information at any time. If you want your information removed from our platform and marketing lists please email hello@swipeflowsocial.com.
Entire Agreement and Misc Terms
These Terms, along with any policies we reference, are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
